The Obama Administration has dedicated $25 million to task the U.S. Department of Labor to combat misclassification of "employee" status under the Fair Labor Standards Act (FLSA).  To that end, DOL has hired hundreds of investigators to implement the Administration's "Misclassification Initiative," to obtain for "misclassified" employees the overtime pay to which they are entitled.

According to DOL, virtually 70 per cent of U.S. employers are out of compliance with the FLSA.  Failure to pay overtime represents the most common FLSA violation, and awards of unpaid overtime represent the bulk of back wages awarded under this Law.  It should not be surprising that FLSA lawsuits alleging systemic misclassification have now become the most frequently-filed, employment-based class action.

The focus of our talk is "10 Sure-Fire Ways to Get Your Company Sued Under the Fair Labor Standards Act."  We will identify and correct commonly-held myths and misunderstandings concerning the standards for determining whether employees are exempt from overtime.

We will also discuss Maryland's new law in this area, which greatly increases penalties for the failure to pay overtime, and goes into effect this October (2010).
